§1. General provisions

The online shop Shinely, available at https://shinely.pl, is run by NEY Maciej Szwarc, ul. Szafarnia 11/F8, 80-755 Gdańsk, Poland, tax ID (NIP) 578-313-34-34 (the “Seller”).

The Seller can be contacted by e-mail at biuro@shinely.pl, via the contact form or by post at the Seller's address.

These terms and conditions (the “Terms”) set out the rules for using the Shop, placing orders and concluding sales contracts, payment, delivery, withdrawal from the contract and complaints. The Terms are available free of charge on the Shop's website - they can be saved and printed.

§2. Definitions

  • Customer - a natural person, a legal person or an organisational unit without legal personality that places an order in the Shop.
  • Consumer - a natural person who concludes a contract with the Seller that is not directly connected with their business or profession.
  • Sole trader with consumer rights - a natural person who concludes a contract directly connected with their business, where the content of the contract shows that it is not of a professional nature for them (in particular in view of the business activity entered in the Polish business register CEIDG); a concept of Polish law.
  • Contract - a distance contract for the sale of a product concluded via the Shop.
  • Order - the Customer's declaration of intent aimed at concluding the Contract, specifying the products, the delivery method and the payment method.

§3. Technical requirements

Using the Shop requires a device with internet access, an up-to-date web browser with JavaScript and browser storage enabled, and an active e-mail address. The Shop works only over an encrypted connection. The Customer must not provide any unlawful content.

§4. Products and prices

Prices in the Shop are gross prices and include VAT. The currency of the prices and the VAT rate depend on the delivery country chosen in the Shop:

  • Poland: Polish zloty (PLN), VAT at the rate applicable in Poland

The delivery cost depends on the delivery country, the delivery method chosen and the order value - the Customer sees it before placing the order, and the total price payable at the last step of the order.

Whenever a price is reduced, the Shop also shows the lowest price of the product in the 30 days before the reduction - for the same delivery country and in its currency. One discount code can be used per order, on the terms stated when the code is made available; a code that reduces the price by a fixed amount or requires a minimum order value is valid only in the currency in which it was made available.

§5. Placing orders and conclusion of the contract

  1. Orders can be placed 24 hours a day, without creating an account.
  2. To place an order, the Customer adds products to the basket, enters their contact and delivery details, chooses the delivery and payment method and then clicks the “Order and pay” button, which means placing an order with an obligation to pay.
  3. After placing the order, the Customer receives an e-mail confirming that it has been accepted - at that moment the Contract is concluded. The e-mail contains a summary of the order, and the Terms remain available on the Shop's website.
  4. The Customer is responsible for the accuracy of the details given in the order.

§6. Payment

  1. Delivery country: Poland - online payments processed by PayU S.A. (BLIK, fast bank transfer, payment card, Apple Pay, Google Pay) and payment on delivery (cash on delivery), if the Shop offers this delivery method.
  2. An order paid online must be paid for within 7 days of placing it - after this period the unpaid order is cancelled, and we inform the Customer by e-mail.
  3. For delivery to Poland, at the Customer's request we issue a VAT invoice - the company details, including the tax identification number, must be entered in the order form.

§7. Delivery

  1. The Shop ships products from its warehouse in Poland. Delivery countries: Poland. Delivery methods and costs depend on the delivery country - current costs are shown on the Delivery and shipping page and in the basket.
  2. Delivery country: Poland - parcels are delivered by InPost to an InPost Paczkomat parcel locker or by InPost courier, including cash on delivery where available. Delivery usually takes 1-2 working days from dispatch.
  3. Orders paid for (or placed cash on delivery) on a Polish working day by the cut-off time shown on the Delivery and shipping page (Polish time) are dispatched the same day, later orders on the next working day.
  4. When receiving a courier parcel, it is advisable to check its condition in the courier's presence and, if it is damaged, to have a damage report drawn up - this makes a complaint easier. The lack of a report does not deprive the Consumer of the right to make a complaint.

§8. Right of withdrawal

  1. The Consumer (and a sole trader with consumer rights) may withdraw from the Contract without giving any reason within 14 days of the day on which they received the product or, where several products are delivered separately, of the day on which they received the last of them.
  2. To withdraw from the Contract, it is enough to send a statement of withdrawal before the period expires - by e-mail to biuro@shinely.pl or by post to the Seller's address. The withdrawal form may be used, but it is not obligatory. The statement can also be submitted online using the Withdraw from the contract here function - the Seller confirms its receipt by e-mail without undue delay.
  3. The product must be sent back to our address in Poland: NEY Maciej Szwarc, ul. Szafarnia 11/F8, 80-755 Gdańsk, Poland - without undue delay and no later than 14 days from the day of withdrawal from the Contract. The Consumer bears the direct cost of returning the product, whichever country it is sent back from.
  4. We refund all payments received, including the cost of delivery to the Consumer (up to the cost of the cheapest delivery method offered to the order's delivery country), without undue delay and no later than 14 days from receiving the statement of withdrawal - in the currency in which the Consumer paid and using the same means of payment, unless the Consumer agrees otherwise. We may withhold the refund until we have received the product back or proof that it has been sent, whichever is earlier.
  5. The Consumer is liable for any diminished value of the product resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning.
  6. The right of withdrawal does not apply in the cases listed in Article 38 of the Polish Consumer Rights Act (ustawa o prawach konsumenta; these exceptions correspond to Article 16 of Directive 2011/83/EU).

§9. Complaints - lack of conformity of the product with the contract

  1. The Seller is liable to the Consumer for any lack of conformity of the product with the Contract that exists at the time of delivery and becomes apparent within 2 years of that time.
  2. Complaints can be made by e-mail to biuro@shinely.pl or by post to the Seller's address. Please give the order number, a description of the problem and - if possible - photos; this speeds up the process.
  3. In the event of a lack of conformity, the Consumer may request repair or replacement of the product and, if this is impossible or is not done within a reasonable time, a price reduction or withdrawal from the Contract (withdrawal is not available if the lack of conformity is minor).
  4. We respond to a complaint within 14 days of receiving it. If we do not respond within this period, the complaint is deemed accepted.
  5. The costs of repair, replacement and delivery of the product under complaint are borne by the Seller.

§10. Sole traders with consumer rights

The provisions on the right of withdrawal, liability for lack of conformity of the product with the Contract and unfair contract terms also apply to sole traders with consumer rights, in accordance with the Polish Consumer Rights Act (ustawa o prawach konsumenta) and the Polish Civil Code (Kodeks cywilny).

§11. Product reviews

Product reviews may only be posted by Customers who have bought the product in the Shop. We publish both positive and negative reviews, do not change their content and do not commission reviews. We do not publish reviews that infringe the law or personal rights.

§12. Out-of-court dispute resolution

The Consumer may use out-of-court complaint and redress procedures - in particular, ask for help from a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or a regional inspectorate of the Trade Inspection (wojewódzki inspektorat Inspekcji Handlowej) in Poland. Information about these procedures is available on the website of the Polish Office of Competition and Consumer Protection (UOKiK, uokik.gov.pl).

In cross-border disputes, a consumer resident in another European Union country can get free help from the European Consumer Centre in their country (ECC-Net; in Poland konsument.gov.pl, in the Czech Republic Evropské spotřebitelské centrum ČR - evropskyspotrebitel.cz, in Slovakia Európske spotrebiteľské centrum v SR - europskyspotrebitel.sk). A consumer resident in the Czech Republic may also contact the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI, coi.gov.cz), and a consumer resident in Slovakia the Slovak Trade Inspection (Slovenská obchodná inšpekcia, SOI, soi.sk) or another alternative dispute resolution body on the list kept by the Slovak Ministry of Economy.

§13. Personal data

The controller of Customers' personal data is the Seller. The rules for processing personal data are set out in the Privacy policy, and the rules for using cookies in the Cookie policy.

§14. Final provisions

  1. The Contract can be concluded in Polish, Czech, Slovak or English - in the language of the version of the Shop in which the Customer places the order. The Czech, Slovak and English versions of the Terms are translations provided for information - in the event of any discrepancy between the language versions, the Polish version prevails. Contracts are governed by Polish law; this choice of law does not deprive the Consumer of the protection afforded by the provisions of the law of the country of their habitual residence that cannot be derogated from by agreement.
  2. The Seller may amend the Terms for important reasons, in particular changes in the law or in payment or delivery methods. Orders placed before an amendment are governed by the Terms in force on the day the order was placed.
  3. Matters not covered by the Terms are governed by Polish law, in particular the Polish Civil Code (Kodeks cywilny) and the Consumer Rights Act (ustawa o prawach konsumenta).
